PROBLEM TO BE SOLVED: To provide a solid-state imaging element having an inner-layer lens for controlling a shading, and an imaging device using the same. SOLUTION: In the solid-state imaging element, assuming that the central position of a microlens 13, the central position of a color filter 11, the central position of the inner-layer lens 9, and the central position of the opening of a shading layer 6 are shifted more toward the center part direction of an effective imaging region than the center of the corresponding light-receiving element, the shift quantity is set to be smaller than the supposed shift quantity obtained from a difference between the position on the optical path of the light and the position corresponding to the center of the light-receiving element, the position on the optical path of the light being calculated by assuming that the main light from the center of the exit pupil of the camera lens incident to the central position of the microlens 13 is refracted depending on a difference of the refractive indexes of the materials of both sides of the boundary and selects an optical path toward the center of the light-receiving element 3, at the boundary incident to the microlens 13 and at each boundary of each material layer on the optical path from the microlens 13 until the light-receiving element 3.
