PURPOSE: A MVP candidate determining method in an Inter prediction is provided to improve Inter prediction efficiency by selecting the adjacent block of the biggest size as the highest priority prediction candidate. CONSTITUTION: The usage of the biggest block or the usage of a block having a Median vector value are able to be selectively set in a picture/slice unit or a CU(Coding Unit). In case of the selective setting, a flag indicating the usage of a corresponding method should be transmitted. A candidate determination method is as follows. First, the block having the Median vector value is set as the highest priority candidate. And TBR is set as a lower priority candidate. Second, the TBR is set as the highest priority candidate.
