PURPOSE: A device for encoding a hierarchical intra prediction mode and a method thereof are provided to improve the whole video compression performance by efficiently transmitting the hierarchical intra prediction mode. CONSTITUTION: An entropy decoder(100) decodes an input bit stream. A de-quantization and inverse transform encoder(110) performs de-quantization and inverse transform for the decoded input bit stream. An intra prediction mode producer(120) decodes an intra prediction mode by using a hierarchical structure. An intra prediction decoder(130) restores an image by intra prediction. An inter prediction decoder(140) restores the image by inter prediction.
