PURPOSE: An image encoding device selecting an adaptive encoding structure and a method thereof are provided to improve a subjective picture quality by using the adaptive encoding structure when transmitting an image through various transmission lines. CONSTITUTION: An encoding unit(110) encodes an input image block. An adaptive coding structure selector(120) compares the same image block of a current frame and a previous frame with an intra encoding mode. If intra encoding modes are same, the adaptive coding structure selector deactivates a transformation and quantization process during an encoding process of the encoding unit.
