PURPOSE: A portable terminal and file transmission and reception method thereof are provided to reduce data transmission traffics by conditionally transmitting files to opponent terminals. CONSTITUTION: A transmission unit transmits an SIP(Session Initiation Protocol) invitation messages to a reception terminal. A reception unit receives the created SIP response message according to a result which is generated by comparing the specific condition with the state of the reception terminal. When the received SIP response message corresponds to the SIP success response message, a control unit(180) controls the transmission unit to transmit files to the reception terminal. The control unit creates the SIP response message transmitted to an originating terminal using a specific condition related to the state of the portable terminal.
