PURPOSE: An apparatus for preventing an unintended backing of a vehicle and a method thereof are provided to prevent crash accidents in advance by compulsorily neutrally controlling a shift level when an accelerator pedal is operated. CONSTITUTION: A backing prevention mode detection part(3) checks whether a vehicle is in the state which satisfies conditions for starting a backing prevention mode or not. A timer(5) measures duration of the backing prevention mode. A neutrality control alarming part informs an operator that a vehicle is neutrally controlled. A backing notice alarming part(7) informs the operator that a shift lever is placed on a reverse gear. A distance meter measures distance to an object located in the rear side.
