PURPOSE: A tethering service determination method and apparatus therefor are provided to determine a tethering service which uses a data service in a mobile communication network. CONSTITUTION: A packet reception unit(610) receives a service packet transmitted from a portable terminal. A packet information extraction unit(630) extracts a TTL(Time To Live) value from a header of the received service packet. When the extracted TTL value is smaller than a reference TTL value, a tethering determination unit(690) determines that the portable terminal is to be used for the tethering service. The packet extraction unit extracts OS(Operating System) information from the header of the received service packet. The tethering determination unit compares the extracted TTL value and a reference TTL value corresponding to the extracted OS information.
