PURPOSE: A device for setting a recording preventing mode in an optical disk drive and a method thereof are provided to automatically set a recording preventing mode, thereby preventing data from being wrongly deleted in a rewritable optical disk. CONSTITUTION: An optical sensor(19) scans a control picture inner ring. The control picture inner ring is recorded in a control picture zone of a write scribe disk. The control picture inner ring has a spoke shape. A microcomputer(15) detects an output waveform of the optical sensor. The microcomputer automatically sets a data recording preventing mode. If the width of a pulse of the output waveform is wider than the width a reference pulse, the microcomputer automatically sets the recording preventing mode.
