PURPOSE: A data streaming packetizing system in a P2P(Peer to Peer) based streaming service and method thereof are provided to maintain synchronization between pieces by creating the emptied pieces. CONSTITUTION: A piece creation unit(1010) creates a piece for data stream received in selected time interval. The piece creation unit creates emptied piece for time interval where the data stream is not received. The created piece transmits the client through a delivery server according to the request of a client. Server usage rates are controlled according to the number of current simultaneous connectors by using the inflow rates of the simultaneous connectors.
