<P>PROBLEM TO BE SOLVED: To provide an occupant identifying device and an occupant identifying method for continually and accurately distinguishing an adult seated on a seat from a child seated on an auxiliary seat. <P>SOLUTION: An occupant identifying device includes a distance image sensor 4 for acquiring distance image data of an object on a seat 1B including an occupant, and upper limb ratio calculating means 30 for determining a volume ratio of an upper limb area of the occupant to the entire volume of the object on the basis of the distance image data acquired by the distance image sensor 4. When the ratio calculated in the upper limb ratio calculating means 30 is equal to or larger than a threshold, the object is identified as an adult.
