PURPOSE: A data transmission and reception apparatus in a communication system and method thereof are provided to adaptively distribute traffic between AP(Access Points) and STA(STAtions) by creating a beacon frame including load elements. CONSTITUTION: A reception unit(110) receives signals from plural terminals in a multi user MIMO(Multi Input Multi Output) type. After the terminals are grouped and confirmed, an allocation unit(120) respectively allocates group ID(Identification) to grouped terminal groups. A generation unit(130) defines load elements. The generation unit generates a beacon frame including the load elements. A transmission unit(140) transmits the beacon frame to the terminals in the multi user MIMO type.
