PURPOSE: An encoder and method for selecting the types of a candidate mode are provided to distinguish CMT(Candidate Mode Types) through a spatial and temporal correlation. CONSTITUTION: A mode determination model determines the sum of a context(310). If the sum of the context is 0, the mode determination model determines the CMT type into a CMT-1 type. If the sum of the context is lower than 4, the mode determination model determines the CMT type into a CMT-2 type(320). If the number of intra mode type is 0, the mode determination model determines the CMT type into CMT-3 type(330).
