PURPOSE: An upgrade server and an operation method are provided to transmit an upgrade message to a mobile terminal from an upgrade server when an operation state of the mobile terminal satisfies an upgrade condition. CONSTITUTION: A processor(120) extracts state information about a mobile terminal from a report message. The processor reports a second message for access induction of the mobile terminal. The processor requests transmission of a second message to an interface(110). A controller(140) supplies upgrade data to the mobile terminal.
