PROBLEM TO BE SOLVED: To decode an encoded stream of a moving image transmitted from an encoding side to a decoding side with a small delay while suppressing quality deterioration of the moving image.

SOLUTION: An encoding unit 1103 encodes a moving image according to a standard having a variable picture rate. An encoding parameter setting unit 1102 sets, for the encoding unit 1103, encoding parameters including decoding ability necessary at least for performing decoding at a time interval between pictures according to a specified picture rate and decoding ability necessary at least for performing decoding at a time interval that is a time period of a multiple of a unit operation time of a virtual decoding buffer that should exist in a decoding side and shorter than the time interval between pictures. The encoding unit 1103 encodes the encoding parameters and inserts them into an encoded stream of the moving image.
