PURPOSE: A channel allocating device and a method thereof are provided to allocate a backup channel with a channel state corresponding to service quality required by a wireless communication system based on IEEE 802.22 standards as an operating channel. CONSTITUTION: An operating channel allocating unit(10) comprises a calculation unit(11) and an operating channel selecting unit(13). The operating channel allocating unit selects one of backup channels using a state value of a backup channel when an incumbent user appears. The operating time slot assignment circuit assigns the selected channel as described above to the operating channel. A backup channel allocating unit(20) selects a channel from an area priority list. The backup channel allocating unit allocates the selected channel as a backup channel.
