<P>PROBLEM TO BE SOLVED: To provide a surgical staple adaptable to a larger range of the thickness of tissue, which provides a surgeon with a high degree of freedom when he/she performs a surgical operation thereby. <P>SOLUTION: The staple 10 has an expandable non-linear backspan 12 and a first leg 14, and a second leg 16.
