PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor that sustainably exhibits relaxation effect for a contact stress of a contact member, and is excellent in potential stability at repeated usage, and to provide a process cartridge and an electrophotographic device having the electrophotographic photoreceptor.

SOLUTION: A charge transport layer which is a surface layer of the electrophotographic photoreceptor has a matrix-domain structure composed of a matrix including a component β (at least one of a polycarbonate resin C having a specific structural repeating unit and a polyester resin D having a specific structural repeating unit), and a charge transport material; and a domain containing a component α (a polyester resin (A) having a specific structural repeating unit containing a specific siloxane site). The Martens hardness of the charge transport layer is 170 N/mm2or higher and 210 N/mm2or lower.
