PURPOSE: A method for encoding video using a conversion unit of a variable tree structure and a device thereof, and a video decoding method and a device thereof are provided to obtain information about an encoding depth by an encoding unit. CONSTITUTION: A conversion unit determining unit(11) converts a current area based on conversion units of a variable tree structure which is generated based on maximum division levels of a conversion unit. The conversion unit determining unit determines conversion units for the current area. An output unit(13) outputs conversion unit layer structure information. The conversion unit layer structure information includes encoded data of the current area, information about a determined encoding mode, and information about the maximum size of the conversion unit about video.
