PURPOSE: A touch malfunction method of a portable terminal and an apparatus thereof are provided to increase the convenience of a user by preventing touch malfunction which is executed in a touch screen area when a touch key is touched. CONSTITUTION: A GUI(Graphic User Interface) screen is outputted(201). When the GUI screen is outputted, the touch is unable to be recognized. A part of the touch screen is inactivated(203). When the GUI screen is outputted, it is confirmed whether an area in which the lowest item is allocated is outputted(205). A part of the touch screen is deactivated when a part of the lowest item is outputted on the touch screen.
