PROBLEM TO BE SOLVED: To provide an occupant discrimination device of a vehicle capable of carrying out precise occupant discrimination by using a load data detected by a smaller number of load sensors against a part on which a load of a seat for the vehicle is applied. SOLUTION: This occupant discrimination device of the vehicle to discriminate classification of an occupant on the seat for the vehicle in accordance with the load applied on the seat for the vehicle is furnished with a state detection means 1 to detect a seating state of the occupant on the seat for the vehicle, a load measuring means 2 to measure the load applied on the seat for the vehicle and a discrimination means 3 to discriminate the classification of the occupant in accordance with a discriminating condition to differ in correspondence with a detection result of the state detection means 1 and a measured result of the load measuring means 2.
