PURPOSE: A device for encoding/decoding a moving picture by adjusting the size of an adaptive macro block and the depth of a lower block based on an image feature and a context and a method thereof are provided to use an optimum macro block size and a lower block depth by GOP/frame/slice unit, thereby increasing the efficiency of compressing a moving picture. CONSTITUTION: A macro block size determining unit(111) adaptively controls the size of a macro block. A macro block size storage unit(112) stores the size of the macro block. A block depth determining unit(113) adjusts the depth of the macro block for a lower block. A block depth storage unit(114) stores the depth of the lower block. A macro block size encoding unit(121) minimizes a data amount about the size of macro block using adjacent and previous encoding information.
