<P>PROBLEM TO BE SOLVED: To provide a wireless communication device provided with a rate fallback mechanism that prevents wasteful consumption of a band. <P>SOLUTION: A communication state of a first access point to which a wireless communication device is being connected and a communication state of an adjacent second access point are compared, and when the communication state of the first access point is better, the number of retransmission times for each transmission rate to the first access point is reduced compared to the case where the second access point is not detected.
