PURPOSE: An apparatus for detecting a moving object and a method thereof are provided to extract the moving object area by separating a non-detected area. CONSTITUTION: An image input unit(210) receives an input image including a moving object area. A control unit(220) divides the input image area into a foreground area and a background area. The foreground area includes an area which is determined as a moving object. The background area does not include the area which is determined as the moving object. The control unit separates the foreground area from the wrongly detected area.
