PROBLEM TO BE SOLVED: To provide a communication device and a communication method capable of reducing generation of distortion, and at the same time freely setting a subcarrier arrangement when some of a plurality of subcarriers are used. SOLUTION: Some subcarriers inside a frequency band are allocated at a subcarrier arranging unit 11 to a signal modulated at a mapping unit 10 to generate a multicarrier signal. Thereafter, the amplitude of the multicarrier signal is limited by an amplitude limiter 14 in accordance with a primary modulating system in the mapping unit 10. Then, the multicarrier signal is transmitted from an antenna 20 through a first frequency converter 17, an amplifier 18 and the like. A level regulator 13 is formed at the prestage of the amplitude limiter 14 to regulate the level of the multicarrier signal, then limit the amplitude of the multicarrier signal by the amplitude limiter 14.
