PROBLEM TO BE SOLVED: To improve the angle characteristics of the incident angle of a Blaze type and transmission type diffraction optical element. SOLUTION: In the Blaze type and transmission type diffraction optical element 101, the normal line of a side wall 131 adjacent to a diffraction surface 132 through which the incident light of the Blase 121 is passed has an inclination so as to be vertical to the center or the center of the gravity of luminous flux which enters into the diffraction surface 132 of the Blaze 121. In the Blaze 121 in a region where the direction of the center or the center of gravity of the luminous flux which enters into the diffraction surface 132 is not vertical to the arrangement direction of the Blaze 121, the angleθ11 between the side wall 131 and the diffraction surface 132 is right angle or near right angle.
