PROBLEM TO BE SOLVED: To provide an eye opening degree determining device and an eye opening degree determining method, capable of accurately detecting the eye opening degree of a subject by removing the influence of disturbance. SOLUTION: The biological state detecting device 10 includes an eye opening degree detecting part 20 for acquiring the eye opening degree data of the subject based on the captured image of the subject's eyes, and an closed eye/opened eye determining part 24 for determining the eye opening degree of the subject based on the eye opening degree data acquired by the eye opening degree detecting part 20. The closed eye or opened eye determining part 24 determines the eye opening degree of the subject based on eye opening degree data selected by a false detection section estimating part 22 according to the difference in the eye opening degree between right and left eyes represented by the eye opening degree data among the eye opening degree data acquired by the eye opening degree detecting part 20. As it is not so often that the eye opening degrees are different between the right and left eyes, and as the difference in the eye opening degree between the both eyes is closely related to the disturbance, the eye opening degree of the subject can be more accurately detected by detecting the eye opening degree of the subject based on the eye opening degree data selected according to the difference in the eye opening degree between the both eyes and removing the influence of the disturbance.
