PROBLEM TO BE SOLVED: To provide a communication method, a mobile station and a base station in a communication system by which the load equalization and quality stabilization of a common channel usable between mobile stations having no individual channel are attained. SOLUTION: In the communication system where the base station transmits predetermined resource information about data transmission to the mobile station, the mobile station performs data transmission using a resource determined on the basis of the predetermined resource information (S963) when a response to a preamble transmitted to the base station is acknowledgement (ACK), and performs the data transmission using a resource determined on the basis of assignment resource information (S955) when the response to the preamble is negative acknowledgement (NACK) and the assignment resource information is received from the base station.
