PROBLEM TO BE SOLVED: To provide an image processing apparatus, an image processing method and a program for surely detecting a fluctuating area from an overall picture, and for highly precisely detecting an object to be monitored. SOLUTION: The image processing apparatus is provided with: a difference processing part for calculating a difference between the image data of one image and the image data of the past image photographed in the past from one image; a fluctuation detection part for calculating the time change of the difference, and for extracting a fluctuation area in a picture equivalent to a section where the fluctuation of nature has been photographed and a non-fluctuation area which is not the fluctuation area based on the periodicity of the time change; and an object detection part for detecting an object moving in the picture by changing the detecting precision according to the fluctuation area and the non-fluctuation area.
