PURPOSE: A motion estimating method and video encoding apparatus are provided to prevent the deterioration of an image pixel according to the motion estimation of a variable sized block and to considerably reduce the quantity of operation. CONSTITUTION: A partition division unit(110) partitions an input frame into a plurality of partitions. An optimal selecting unit(130) selects an optimal mode of a plurality of main modes. A skip determination unit(140) skips a sub mode. A motion estimation unit(150) estimates motion of a current partition in a skipped mode. A motion compensation unit(160) performs motion compensation of a reference frame.
