<P>PROBLEM TO BE SOLVED: To provide a nonaqueous electrolyte battery which can control the generation of gas at the time of high temperature preservation and also can improve first time charge and discharge efficiency and a discharge capacity maintenance rate when repetition charging is performed. <P>SOLUTION: An electrolyte 36 which contains an electrolytic solution and a polymer compound swelling by absorbing the electrolytic solution, is the so-called electrolyte of gel. The electrolytic solution contains solvent and electrolyte salt.
