Disclosed is a magnetoresistive effect element that is provided with a laminated body, which is provided with: a cap layer (19); a magnetization fixed layer (14); a magnetization free layer (18) provided between the cap layer (19) and the magnetization fixed layer (14); a spacer layer (16) provided between the magnetization fixed layer (14) and the magnetization free layer (18); and a functional layer (21), which is provided between the magnetization fixed layer (14) and the spacer layer (16), or between the spacer layer (16) and the magnetization free layer (18) in the magnetization fixed layer (14), or between the magnetization free layer (18) and the cap layer (19) in the magnetization free layer (18), and which has an oxide containing at least one element selected from among Zn, In, Sn, and Cd, and at least one element selected from among Fe, Co, and Ni. The magnetoresistive effect element is also provided with a pair of electrodes (11, 20) for having a current flow perpendicularly to the film surfaces of the laminated body.
