PROBLEM TO BE SOLVED: To provide an apparatus and method for determining seat occupancy capable of accurately determining a seating state, in a vehicle seat having the lifter function. SOLUTION: The vehicle seat includes a lifter mechanism capable of changing a height position of a seat cushion. A pair of left-right seating sensors 2RR and 2RL for detecting a seating load to the seat cushion, are installed in a rear part of the seat cushion. A controller 3 calculates an added-up load by adding a detecting load by the seating sensors 2RR and 2RL, and determines that a vehicle seat 1 is an adult seating state when the added-up load is a threshold value or more, and determines that the vehicle seat 1 is a child seat installing state when the load is smaller than the threshold value. The controller 3 calculates a lateral difference load by subtracting the detecting load by the rear left seating sensor 2RL from the detecting load by the rear right seating sensor 2RR, and sets the threshold value of the added-up load large in response to the fact of becoming large in the lateral difference load.
