<P>PROBLEM TO BE SOLVED: To provide an optical compensation film that has large retardation in a film surface and in a thickness direction, has no film warpage (curling) and has film smoothness. <P>SOLUTION: In the biaxially stretched optical compensation film which includes at least two or more maleimide system resin layers on a transparent resin film base material, a relation of three-dimensional refractive indexes is nx>ny>nz or ny>nx>nz or nx=ny>nz, wherein stretching axis directions are made to be a x-axis and a y-axis in the film surface and an out-of-plane direction orthogonally crossing them is made to be a z-axis and a refractive index in an x-axis direction is nx, a refractive index in a y-axis direction is ny, a refractive index in a z-axis direction is nz.
