PROBLEM TO BE SOLVED: To provide a data transmitting apparatus, a data receiving apparatus and a data transmitting/receiving system, capable of transmitting copyright protection contents having various copy control information in a home network environment. SOLUTION: The data transmitting apparatus for transmitting copy-limited AV data includes: an authentication unit for performing authentication processing with the data receiving apparatus; a transmission unit for transmitting a packet including the AV data and first copy control information or a packet including second copy control information; a discrimination unit for discriminating the AV data and the first copy control information and the second copy control information; a first generation unit for generating the AV data and the first copy control information; and a second generation unit for processing the second copy control information.
