PURPOSE: A system software update apparatus of a digital broadcasting receiver and method thereof are provided to automatically change the scan starting time of OTA and to prevent SSU(System Software Update) operation error. CONSTITUTION: In case one tuner is used at time when an OTA(Operational Transconductance Amplier) stream scan mode is set up in a digital broadcasting receiver, OTA scan operation is performed by using a tuner(S12). An effective system software is downloaded through the scan of the OTA(S20). The system is off after updating the system software(S23).
