An electrophotographic photosensitive member capable of persistently exerting an effect of mitigating contact stress with contact members and excellent also in potential stability during repeated use is provided, and a process cartridge and an electrophotographic apparatus having the electrophotographic photosensitive member are provided. A charge transport layer serving as a surface layer of the electrophotographic photosensitive member contains a polyester resin having a repeating structural unit represented by the following formula (1) and a repeating structural unit represented by the following formula (2), as a binder resin; the content of a siloxane moiety of the polyester resin is not less than 5% by mass and not more than 30% by mass relative to the total mass of the polyester resin; and the content of the polyester resin in the charge transport layer is not less than 60% by mass relative to the total mass of the whole binder resin in the charge transport layer.
