PURPOSE: An apparatus and method for receiving peer-to-peer data are provided to receive data by avoiding the congestion of a network. CONSTITUTION: A reception unit(210) receives from plural data transmission devices the segments which constitute data by using sessions corresponding to data transmission devices(291,292). Based on the states of the sessions, a congestion judgment unit(230) judges the congestion of a network which passes through the segments. If the network is in a congestion state, an interruption session election unit(240) selects an interruption session among the plural sessions.
