An encryption algorithm negotiation method, network element and mobile station are disclosed by the embodiments of the present invention, wherein the method includes: obtaining the information that the inserted card of the mobile station does not support the first encryption algorithm; according to the information that the inserted card of the mobile station does not support the first encryption algorithm, deleting the first encryption algorithm from the encryption algorithm list which the core network element itself permits; sending the encryption algorithm list without the first encryption algorithm to an access network element, which enables the access network element to select an encryption algorithm according to said encryption algorithm list and terminal capacity information sent by the mobile station and to send the selected encryption algorithm to the mobile station. The method, network element and mobile station provided by the present invention can avoid faults in the process of the encryption as the inserted card of the mobile station does not support a certain encryption algorithm.
