<p><P>PROBLEM TO BE SOLVED: To provide a radio communication apparatus to satisfy permissible delay regardless of the data small in permissible delay amount, and to provide a radio communication method. <P>SOLUTION: A data type determining portion 101 determines whether delay of transmission data or control information is allowed or not, and a pilot signal insertion controller 102 decides that a pilot signal is arranged adjacent to data which is not allowed to delay, based on pilot insertion interval information and permissible delay information.
