PURPOSE: An apparatus for video encoding and decoding considering scanning order of coding units with hierarchical structure is provided to encode and decode high definition video contents. CONSTITUTION: A video decoding apparatus comprises a receiving part(1501) which receives bitstream about an encoded video, and performs parsing, an extracting unit(1520) which extracts encoded video data of picture which is allocated to a maximum encoding unit, encoding depth, and information about encoding mode, and a data decoding unit(1530) which decodes the encoded video data by the maximum decoding unit based on decoding depth, and information about decode mode.
