PROBLEM TO BE SOLVED: To provide a punching shear device used for forming a thermit welded joint in which the fatigue strength of a rail weld zone is improved compared with the conventional one, and to provide a method for forming a welded joint using the same. SOLUTION: The punching shear device 26 is provided with: a pair of trimmer bites 28, 28' punching and shearing molten metal remaining in molds 9, 9' together with a part of the molds 9, 9'; and a pair of fixing tools 32, 32' holding a rail 10, and the pair of trimmer bites 28, 28' and the pair of fixing tools 32, 32' are arranged symmetrically with the rail 10 held, respectively. On both the sides held with the rail 10, hydraulic cylinders 37 in which rods 33 move to the elongating directions of the rolls 10 are installed, respectively, a movable horizontal part 35 is constructed between the pair of rods 33, and the movable crossing part 35 is slidable to the elongating directions of the rail 10. A pair of trimmer bites 28, 28' are pivoted to the movable horizontal part 35 by rolling shafts 30, and are made rotatable within the horizontal plane. COPYRIGHT: (C)2011,JPO&INPIT
