The present invention is directed to improvement of the throughput characteristic of the whole system by reducing the probability that an MCS including a different modulating scheme will be selected. There are included a CQI information decoding unit (101) that is operative to decode the CQI of a downstream transport stream; and an MCS selecting unit (102) that has a table (MCS table 1021), which defines modulating/coding schemes (MCS) appropriate to the CQIs of downstream transport streams and which also defines groups of modulating/coding schemes in each of which the same modulating scheme is included and transmission rates are specified in ascending order, and that is operative to select, based on the CQI of the downstream transport stream decoded by the CQI information decoding unit (101), the MCS of the downstream transport stream.
