PROBLEM TO BE SOLVED: To improve quality of an encoded audio signal. SOLUTION: An audio encoding device includes: a process for creating a sub-band signal of a high frequency section by converting an input signal to the sub-band signal, and by copying the sub-band signal of a low frequency section; and a process for adding an artificial tone signal in order to regenerate a tone nature signal which is included in the input signal, and which is not regenerated by copying the sub-band signal, wherein by newly providing a means for analyzing a harmonics structure of the input signal, it is judged whether or not the input signal has the harmonic structure. When it has the harmonics structure, disturbance of a harmonics interval is prevented and sound quality is improved by not adding the tone signal. COPYRIGHT: (C)2008,JPO&INPIT
