Provided is an optical element in which a first band-shaped region arranged with lattice bumps (103) at a first period and a second band-shaped region not provided with lattice bumps are arranged at a second period on a substrate (101). The first period is large enough not to diffract the light used. The second period is large enough to diffract the light used. Films (105,107,109) having higher refraction than the refraction of the materials of the lattice bumps are provided on the first band-shaped region and the second band-shaped region. The shape and the material of the optical element are determined so that light in the first polarization state which passes through the substrate surface is not diffracted, and light in the second polarization state which passes through the substrate surface is diffracted.
