PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor that is hard to cause peeling between a plurality of a-SiC intermediate layers, even if the plurality of a-SiC intermediate layers are arranged between an a-Si photoconducting layer and an a-SiC surface layer, and to provide an electrophotographic apparatus having the electrophotographic photoreceptor. SOLUTION: The electrophotographic photoreceptor has a change layer consisting of the a-SiC intermediate layers of not less than five layers between the a-Si photoconducting layer and the a-SiC surface layer. When selecting two adjacent layers in the a-SiC intermediate layers whose C/(Si+C) is 0.35-0.65 from among the a-SiC intermediate layers included in the change layer, an increase rate (increase rate between layers) between the C/(Si+C) of the a-SiC intermediate layer at a photoconducting layer side and the C/(Si+C) of the a-SiC intermediate layer at a surface layer side is≤19%.
