PROBLEM TO BE SOLVED: To efficiently transmit retransmission packets in accordance with the state of a transmission path in a mobile communication system for transmitting packets. SOLUTION: A transmitter includes a radio section for transmitting data, a dividing section for dividing the transmission data into a plurality of data upon receiving a notice on reception failure of the transmission data transmitted by the radio section, and a control section for causing the radio section to transmit the plurality of data by applying a modulation system having a modulation rate lower than that of the modulation system applied in that transmission of the transmission data.
