<P>PROBLEM TO BE SOLVED: To provide a device and method for recording information which provides high signal quality during reproduction. <P>SOLUTION: Signal light SL is modulated by a spatial modulation device 108 using a modulation technique, where two elements×two elements are the minimum encoding unit, and of the encoding unit, at least three elements are dark bits, and the remaining elements are bright bits. A phase modulation element 110 modulates the signal light to a first phase state and a second phase state for each phase modulation region equal to the size of the encoding unit.
