PROBLEM TO BE SOLVED: To provide an image processing apparatus which, if a document image is enlarged or if some area of the document image is designated for subsequent image processing, can prevent leakage of information and prevent the error of detecting a document image prohibited for copying, and an image forming apparatus having the image processing apparatus. SOLUTION: If an image derived from RGB image data accepted by an image processing unit 10 and an ICU 22 is enlarged by a magnification changing unit 221 of the ICU 22 (or if designation of an area in the image is accepted by an operation unit), an information leakage prevention ID mark detection unit 124, a positional relationship calculating unit 125, and a counterfeit prevention ID mark detection unit 126 detect whether or not patterns indicating an information leakage prevention ID mark and a counterfeit prevention ID mark are separately included in all the areas of the image and in the area to be enlarged (or the area whose designation has been accepted).
