PROBLEM TO BE SOLVED: To provide a cleaning device with a structure capable of maintaining successful cleaning performance for a long period, and to provide an image forming apparatus having the cleaning device. SOLUTION: In the cleaning device provided with: a conductive member 16 which is arranged on an image carrier 1 by contact, to which prescribed voltage is applied, and charges toner on the image carrier to be aligned in a single polarity; a cleaning member 21 which is located on the downstream side in the toner conveyance direction of the image carrier to the conductive member and is arranged on the image carrier by contact, to which the prescribed voltage is applied, and which electrically adsorbs the toner from the image carrier; a first collection member 23 which is arranged on the cleaning member by contact, to which the prescribed voltage is applied, and which electrically adsorbs the toner from the cleaning member; and a second collection member 24 which is arranged on the first collection member by contact, to which the prescribed voltage is applied, and which scratches the toner from the first collection member, a discharging means for discharging surface potential of the image carrier is provided on the upstream side from a transfer means 13 in the rotating direction of the image carrier.
