PROBLEM TO BE SOLVED: To provide a fixing device which adjusts a detection surface of and an interval between a heat roller and a temperature detection means to using one member in multiple stages, and can suppress an increase of the number of components and working man-hours, and to provide an image forming apparatus with the same. SOLUTION: In the fixing device 8, a terminal 33 and a mounting member 37 of a thermostat 30 are fixed in a state that a spacer member 41 is inserted between them, a shaft 35a of a screw 35 penetrates a through hole 33a of the terminal 33 and a hole 43 of the spacer member 41, and is screwed into a boss 39 which projects from the mounting member 37. The hole 43 is formed of: a first hole 45 which the tip 39a of the boss 39 penetrates; a second hole 46 which has a peripheral part 46a with which the tip 39a of the boss 39 overlaps; and a third hole 47 which has a peripheral part 47a at which a folding part 49 with which the tip 39a of the boss 39 overlaps is formed.
